Please read these Terms and Conditions carefully before using the MyYacht.me platform. By accessing or using our platform, you agree to be bound by these Terms.
MyYacht.me operates only as an online booking platform and intermediary. We do not own, operate, manage, crew, inspect, or provide yachts or yacht charter services. The charter contract is concluded directly between the Client and the Boat Owner/Operator identified in the listing and booking confirmation. The Boat Owner/Operator's legal identity will be displayed before you submit a booking request and will appear in your booking confirmation.
Key points you must understand:
- MyYacht.me is a BOOKING PLATFORM, not a yacht charter provider.
- Your charter contract is with the BOAT OWNER, not with MyYacht.me.
- Boat Owners are INDEPENDENT BUSINESSES, not our employees.
- We facilitate bookings but do NOT operate yachts or provide charter services.
- Prepayments are NON-REFUNDABLE if you cancel (subject to mandatory consumer rights).
1. Definitions
1.1 "Platform" means the MyYacht.me website (www.myyacht.me), mobile applications, and related booking services operated by INLD LIMITED, Company Number 12040493, registered office Redhill Marina, Ratcliffe-on-Soar, Nottingham, England, NG11 0EB, United Kingdom (hereinafter "MyYacht.me", "we", "us", or "our"). Upon registration of a Montenegro entity, these Terms will be updated accordingly.
1.2 "User" — any person who accesses or uses the Platform, whether as a Client, Boat Owner, or visitor.
1.3 "Client" or "You" — a User who makes a Booking through the Platform to charter a yacht.
1.4 "Boat Owner" or "Operator" — the independent third-party individual or company that owns and operates the yacht listed on the Platform. Boat Owners are independent contractors, NOT employees, agents, or representatives of MyYacht.me.
1.5 "Charter" — the yacht rental service provided by the Boat Owner to the Client, including yacht, crew, and associated services.
1.6 "Charter Contract" — the contract formed directly between Client and Boat Owner when the Boat Owner accepts a Booking request.
1.7 "Booking" — a reservation made by a Client for a Charter on a specific date and time.
1.8 "Prepayment" or "Deposit" — the advance payment to secure the reservation, typically 30%–100% of the total Charter price.
1.9 "Balance" — the remaining amount owed by the Client to the Boat Owner after Prepayment. Typically paid directly to the Captain on the day of Charter.
1.10 "Captain" or "Skipper" — the licensed boat operator designated by the Boat Owner. Employed by the Boat Owner, not by MyYacht.me.
1.11 "Platform Fee" — fee charged by MyYacht.me for Platform Services. Included in the total price displayed to the Client.
1.12 "Platform Services" — online intermediation services: listing display, booking-request functionality, payment facilitation, communication tools, booking-related support.
1.13 "Operator Services" — the yacht, captain, crew, maritime operation, safety management, route, onboard service, and related charter services provided solely by the Boat Owner.
1.14 "Force Majeure" — circumstances beyond the reasonable control of any party (natural disasters, extreme weather, war, civil unrest, strikes, government actions, pandemics).
2. About MyYacht.me — Platform Model
2.1 What we are. MyYacht.me provides online intermediation services that enable Clients and independent Boat Owners/Operators to find each other and conclude direct Charter Contracts. MyYacht.me does not itself provide, operate, organise, package, or perform yacht charters, excursions, tours, maritime transport, or tourist services.
Our Platform allows you to browse available yachts from independent Boat Owners; view Boat Owner details, ratings, and reviews; submit booking requests; process payments securely; communicate with Boat Owners; and access customer support for booking-related questions.
2.2 What we are NOT. MyYacht.me is NOT a yacht charter provider or operator, NOT a tourist agency or tour operator, NOT an employer or principal of Boat Owners, NOT a party to the Charter Contract, and NOT responsible for the Charter execution.
2.3 Your Charter Contract. When you make a Booking through MyYacht.me, you are entering into a Charter Contract DIRECTLY with the Boat Owner whose yacht you have selected, NOT with MyYacht.me. MyYacht.me acts only as an intermediary to facilitate your Booking and payment. We are not a party to your Charter Contract with the Boat Owner. The Boat Owner is solely responsible for providing the yacht in proper condition, a qualified Captain and crew, safety, maritime compliance, and necessary licences, permits, and insurance.
2.4 Independent contractor relationship. Boat Owners operate autonomously. They set their own prices, maintain their own yachts and equipment, employ their own crew, carry their own insurance, make their own operational decisions, and are NOT controlled or directed by MyYacht.me in day-to-day operations.
3. How the Platform Works
3.1 Browsing and search. You can browse available yachts without creating an account. Each yacht listing includes specifications, photos and description, the Boat Owner's legal name or registered trade name, ratings and reviews, pricing, and an availability calendar.
3.2 Operator transparency. The Boat Owner's identity (legal name or registered trade name) is displayed on every yacht listing BEFORE you make a Booking. You always know which independent operator you are booking with. The Boat Owner's identity also appears in your Booking confirmation.
3.3 Booking process. Step 1: browse and select a yacht. Step 2: total price shown (yacht rental price set by the Boat Owner + Platform Fee). Step 3: submit Booking request and pay Prepayment. Step 4: Boat Owner has 6–24 hours to confirm or decline. Step 5: if confirmed, you receive a Booking confirmation with all Charter details. Step 6: Captain contact details provided 1 day before the Charter. Step 7: meet the Captain and pay any Balance directly. Step 8: enjoy your Charter.
3.4 Booking confirmation. Confirmation email includes the booking reference, Boat Owner details, yacht details, Charter date/time/duration, meeting point, total price breakdown, cancellation policy, and safety information. If the Boat Owner declines, you receive a full Prepayment refund (100%) and no fees are charged.
4. Registration and Account
4.1 Account creation. Creating an account is optional. You can book as a guest without registering. Benefits of an account include saved details for faster checkout, booking history, favourite yachts, and personalised recommendations.
4.2 Account requirements. You must be at least 18 years old, provide accurate and complete information, choose a secure password, and verify your email. You are responsible for confidentiality of your login credentials and all activities under your account.
4.3 Group bookings. If you book on behalf of others, you confirm you are authorised to do so and that you will ensure all passengers are informed of and comply with these Terms, Boat Owner rules, and Captain safety instructions.
5. Booking Process
5.1 Booking request. Submitting a Booking request is an offer to enter into a Charter Contract with the Boat Owner. The request is NOT a confirmed Booking until the Boat Owner accepts.
5.2 Boat Owner confirmation. The Boat Owner has up to 6–24 hours to accept, decline (full refund issued), or request modifications.
5.3 Balance payment. Any Balance must be paid directly to the Captain or Boat Owner on the day of the Charter, unless otherwise explicitly agreed. The Captain or Boat Owner must issue a receipt for any cash Balance.
5.4 Booking modifications. Contact the Boat Owner through the Platform. The Boat Owner must agree to changes. Modification requests less than 48 hours before the Charter may not be accepted.
5.5 No-show policy. If you fail to arrive within 30 minutes of the scheduled Charter start time without prior notice, the Boat Owner may treat the Charter as cancelled. Prepayment is non-refundable. The Boat Owner may claim additional documented losses only to the extent permitted by law and only where reasonable and not already compensated by the Prepayment.
6. Prepayment
6.1 Prepayment requirement. All Bookings require a Prepayment. The amount depends on Charter price, season, lead time, and Boat Owner requirements. Typically 30%–100% of the total Charter price. The exact amount is displayed during checkout before payment.
6.2 NON-REFUNDABLE — Client cancellation. The Prepayment is NON-REFUNDABLE if you cancel the Booking for any reason (change of plans, personal emergency, travel disruption, illness, change of mind, finding a better price elsewhere). The Boat Owner relies on your Booking and may decline other requests for that time slot.
6.3 REFUNDABLE — Operator cancellation. Full refund (100%) if the Boat Owner cancels, fails to appear, the yacht is unavailable due to the Owner's fault, or the Boat Owner breaches the Charter Contract. Refund within 5–7 business days.
6.4 REFUNDABLE — Weather cancellation. Full refund (100%) if the Charter is cancelled due to adverse weather, as determined by the Captain. The Captain's decision is final for operational and safety purposes. This does not limit any mandatory legal rights you may have.
6.5 REFUNDABLE — Force Majeure. Full refund (100%) for natural disasters, government restrictions, port closures, pandemic-related lockdowns, or war/civil unrest.
7. Pricing and Fees
7.1 Price setting. Boat Owners independently set the base rental price for their yachts. MyYacht.me does not control or dictate Boat Owner pricing. MyYacht.me charges a separate Platform Fee, clearly disclosed before Booking.
7.2 Price transparency. All prices are displayed in Euros (EUR). The price shown at checkout is the final price for the services expressly included in your Booking confirmation. Additional services or route changes you request may incur additional charges agreed with the Boat Owner. The total price includes yacht rental + Platform Fee — no hidden fees.
7.3 Inclusions and exclusions. Price typically includes yacht rental, Captain (if listed as included), standard fuel for typical routes, and the Platform Fee. Price does NOT include (unless explicitly stated) additional fuel for extended routes, food and beverages, transfers to/from marina, water-sports equipment rental, or gratuities for crew (optional).
8. Payment
8.1 Payment methods. Credit/debit cards (Visa, Mastercard, American Express) via Stripe; PayPal; bank transfer (where available, as shown at checkout); cryptocurrency via Cryptadium where available and as shown at checkout.
8.2 Payment processing. Prepayment is processed by our secure third-party payment processors (Stripe, PayPal, or other authorised processors). MyYacht.me does NOT store your full credit-card details.
8.3 Payment allocation. The Boat Owner's Charter Fee portion is held and transferred to the Boat Owner after successful completion of the Charter; the Platform Fee portion is retained by MyYacht.me for providing the Platform Services.
8.4 Balance payment to Captain. Any Balance must be paid directly to the Captain or Boat Owner on the day of the Charter, BEFORE departure. A receipt or written payment confirmation must be issued for any cash Balance.
8.5 Receipts and invoices. MyYacht.me issues a receipt or invoice for the Platform Fee. The Boat Owner issues any receipt or invoice for the Charter Fee and Balance payment.
9. Cancellation and Refunds
Cancellation and refund rules are governed by the full Refund & Cancellation Policy, which is part of and must be read together with these Terms.
9.1 Client cancellation. If you cancel your Booking, your Prepayment is NON-REFUNDABLE (§6.2), subject to mandatory consumer rights and the exceptional-circumstances review described in the Refund Policy. To cancel, contact support@myyacht.me with your booking reference.
9.2 Operator cancellation. Full refund (100%) of all amounts paid within 5–7 business days.
9.3 Weather cancellation. If the Captain cancels for safety reasons, full refund (100%). No penalties or fees. You may rebook subject to availability.
9.4 Force Majeure cancellation. Full refund (100%). Neither party is liable for damages.
9.5 Partial Charter completion. If the Charter is cut short due to weather developing during the Charter, the Captain's decision is final and no refund is provided for a partial Charter. If cut short due to boat mechanical failure, a pro-rata refund may be available at the Boat Owner's discretion. If terminated due to Client misconduct, no refund is provided.
9.6 No-show by Client. Prepayment non-refundable. The Boat Owner may claim additional documented losses only to the extent permitted by law and only where reasonable.
9.7 No-show by Boat Owner. Full refund (100%). We will attempt to find an alternative yacht if time permits.
9.8 Refund processing. Refunds processed within 5–7 business days of the cancellation decision. Funds may take an additional 3–10 business days to appear depending on your bank. Refunds are issued to the original payment method.
9.9 Consumer rights protection. Nothing in these Terms is intended to exclude or limit any mandatory consumer rights that cannot be excluded or limited under applicable law. If you are a consumer in the EEA, United Kingdom, Switzerland, or another jurisdiction with mandatory consumer-protection laws, you retain all statutory rights. Mandatory legal provisions prevail over these Terms to the extent of any conflict.
10. Operator Responsibility
10.1 Boat Owner obligations. Provide a seaworthy yacht in good working condition with all safety equipment onboard and functional; employ a qualified, licensed Captain who is sober and fit for duty; conduct pre-departure safety briefings and provide life jackets; hold all required licences, permits, and valid yacht registration; maintain required insurance (yacht liability and third-party liability); arrive at the meeting point on time and provide the Charter as described in the listing; treat Clients with respect and professionalism.
10.2 Platform verification disclaimer. MyYacht.me may request documentation from Boat Owners as part of onboarding, but does not independently inspect yachts or guarantee completeness, validity, adequacy, or ongoing accuracy of such documentation. Any "verified" or similar label means only that the Boat Owner has provided information or documents to the Platform.
10.3 Client remedies against Boat Owner. Your Charter Contract is with the Boat Owner, not MyYacht.me. Raise issues with the Boat Owner/Captain immediately, document problems, and contact MyYacht.me customer support to report the issue. We may remove Boat Owners from the Platform for repeated violations or serious safety issues.
11. Platform Responsibility
11.1 What we are responsible for. Maintaining the website and apps in working condition, processing booking requests accurately, processing payments securely, and providing customer support for Platform-related issues.
11.2 What we are NOT responsible for. Condition, safety, or operation of any yacht; behaviour or qualifications of any Captain or crew; weather; route changes by the Captain; quality of the Charter experience; Boat Owner cancellations or no-shows; Boat Owner violations of law; misrepresentations in listings; disputes between Clients and Boat Owners; your travel arrangements; your health or fitness; your personal property; or interactions with other passengers.
11.3 Facilitation only. MyYacht.me's role is strictly limited to facilitating bookings between Clients and independent Boat Owners. We are an intermediary platform, not a service provider.
12. Captain's Authority
12.1 Captain is in command. During the Charter, the Captain has authority over operation of the yacht, all safety decisions, route and itinerary, weather assessments, and passenger conduct. The Captain's decisions are final for operational and safety purposes. This does not limit any mandatory legal rights you may have after the Charter.
12.2 Safety decisions. The Captain may cancel the Charter if weather is unsafe; return to port early if conditions deteriorate; alter the planned route for safety; refuse to depart if passengers are intoxicated or behaving dangerously; remove disruptive passengers (Client forfeits all payments); and call emergency services if necessary.
12.3 Client must comply. Follow Captain's instructions; wear life jackets when required; stay in designated areas; do not interfere with operation; do not endanger yourself or others; respect decisions on weather, route, and safety. Failure to comply may result in Charter termination without refund.
13. Client Obligations
13.1 Accurate information. Full name, contact details, number of passengers (including ages if children), special requirements relevant to safety, emergency contact. Medical details should be provided only where relevant for safety — see our Privacy Policy for processing.
13.2 Timely arrival. Arrive at the meeting point on time. Significant lateness (30+ minutes) may result in cancellation without refund.
13.3 Sobriety and fitness. You must not be heavily intoxicated on arrival. The Captain has the right to refuse boarding to intoxicated or unfit passengers (no refund).
13.4 Liability for damage. If you damage the yacht or equipment, you are liable for the cost of repair or replacement, payable directly to the Boat Owner.
14. Prohibited Activities
The following activities are STRICTLY PROHIBITED during the Charter:
- Drug use or possession (including marijuana)
- Weapons or firearms
- Smuggling or illegal border crossing
- Jumping or diving from the yacht in unsafe areas
- Swimming in prohibited zones or dangerous conditions
- Operating yacht equipment without Captain's permission
- Littering or throwing trash into the sea
- Fighting, harassment, or aggressive behaviour
- Disobeying the Captain's instructions
- Drone use or commercial filming without prior written approval
If you engage in prohibited activities the Captain may terminate the Charter immediately (no refund), you may be reported to authorities and banned from the Platform, and you may be liable for fines or legal consequences.
15. Liability Limitations
15.1 Mandatory rights preserved. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, wilful misconduct, gross negligence, death or personal injury caused directly by MyYacht.me's own unlawful act or omission, or mandatory consumer rights.
15.2 Platform liability cap. Subject to §15.1, MyYacht.me's total liability to you for any claim related to the Platform or a Booking is LIMITED to the amount you paid for that Booking.
15.3 No liability for Charter issues. MyYacht.me, as a booking platform and intermediary, is NOT liable for personal injury, illness, or death; lost, stolen, or damaged personal property; yacht accidents, collisions, or mechanical failures; seasickness or food poisoning; Charter quality; route or itinerary changes; or weather. Your Charter Contract is with the Boat Owner.
15.4 Assumption of risk. By booking a Charter, you acknowledge inherent risks of boating including seasickness, weather changes, mechanical failures, personal injury from slips/falls/accidents, and sun exposure. Consider travel insurance.
16. Insurance
16.1 Boat Owner insurance. Boat Owners are required to maintain yacht liability insurance and third-party liability insurance. MyYacht.me may request documentation as part of onboarding but does not independently verify or guarantee coverage.
16.2 Client travel insurance. We STRONGLY RECOMMEND that you purchase travel insurance covering trip cancellation (to protect your non-refundable Prepayment), medical expenses, personal accident, lost or damaged luggage, and emergency evacuation. MyYacht.me does NOT provide travel insurance.
16.3 Platform insurance. MyYacht.me may maintain professional liability insurance (E&O) for Platform operations. This does NOT cover your personal injury or property damage during a Charter, Boat Owner negligence, or Charter-related incidents.
17. Personal Data
17.1 Data processing. See our Privacy Policy for detailed information on how we process personal data.
17.2 Data sharing with Boat Owners. When you make a Booking we share your contact information (name, phone, email) with the Boat Owner so they can confirm Charter details, provide Captain contact information, and communicate about the Charter. Boat Owners are independent data controllers for the data they receive.
17.3 Lawful basis for processing. Performance of contract, legal obligation, legitimate interests, and consent (where required). You have the right to withdraw consent at any time. See the Privacy Policy.
18. Intellectual Property
18.1 Platform content. All content on the Platform — website design, layout, logos, trademarks, brand elements, text, graphics, images (except user-generated content and Boat Owner listings), software, code, databases, and technical infrastructure — is owned by MyYacht.me or licensed from third parties, and is protected by intellectual-property laws.
18.2 Prohibited uses. You may NOT copy, reproduce, or republish Platform content, use our trademarks without permission, create derivative works, scrape or extract data using automated tools, or reverse engineer the Platform software.
18.3 User content. If you submit content (reviews, photos, comments), you retain ownership. You grant MyYacht.me a worldwide, royalty-free licence to use, display, and distribute your content on the Platform.
19. Dispute Resolution
19.1 Disputes about the Charter. Try to resolve directly with the Boat Owner. Contact MyYacht.me support at support@myyacht.me — we will attempt to mediate. Your Charter Contract is with the Boat Owner; we are not a party to Charter-related disputes.
19.2 Disputes about the Platform. Contact support@myyacht.me. We respond within 7 business days.
19.3 Governing law. These Terms are governed by the laws of Montenegro, without regard to conflict of law principles.
19.4 Jurisdiction. Any legal action related to these Terms or the Platform must be brought in the courts of Podgorica, Montenegro.
19.4A Mandatory consumer jurisdiction. If you are a consumer resident in the EEA, United Kingdom, Switzerland, or another jurisdiction with mandatory consumer-protection rules, nothing in §19.3 or §19.4 deprives you of the protection of mandatory laws or courts available to you in your country of habitual residence. You may bring proceedings either in Podgorica or in the courts of your country of habitual residence. MyYacht.me may only bring proceedings against you in the courts of your country of habitual residence.
19.5 Class action waiver. To the extent permitted by applicable law, you agree to resolve disputes on an individual basis. This waiver does not apply where consumer-protection law in your jurisdiction prohibits class action waivers.
19.6 AML/KYC compliance. We may refuse, suspend, or cancel a Booking where required to comply with anti-money laundering, know-your-customer, sanctions, fraud prevention, payment security, or legal obligations.
20. Modifications to Terms
20.1 Right to modify. MyYacht.me reserves the right to modify these Terms at any time.
20.2 Notification of changes. Material changes: update of the "Last Updated" date, email notification to active Users, and a prominent notice on the Platform for at least 30 days.
20.3 Acceptance of changes. Continued use after the effective date constitutes acceptance. Bookings confirmed before the effective date of modified Terms remain subject to the Terms in effect at the time of Booking, unless changes are required by law.
21. Contact Information
21.1 Platform support. Email support@myyacht.me, Phone / WhatsApp +382 68 758 345. Hours: 09:00 – 20:00 (Montenegro time), 7 days a week.
21.2 Legal entity. INLD LIMITED, Company Number 12040493, registered office Redhill Marina, Ratcliffe-on-Soar, Nottingham, England, NG11 0EB, United Kingdom. Upon registration of a Montenegro entity, these Terms will be updated to reflect the new operating entity.
21.3 Complaints. Formal complaints to legal@myyacht.me with subject "Formal Complaint - [Booking Reference]". Response within 14 business days.
Language. These Terms are published in English. If translated, the English version prevails unless mandatory local law requires otherwise.
Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement.
Severability. If any provision is invalid or unenforceable, the remaining provisions remain in full effect.
Waiver. Our failure to enforce any right or provision does not constitute a waiver.
Assignment. Bookings are personal and non-transferable. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
