Welcome aboard

Thank you for choosing MyYacht.me to book your yacht charter. To ensure a safe, enjoyable, and memorable experience for all guests, please read and follow these House Rules. They apply to ALL guests on board and form part of your Charter Contract with the independent Boat Owner. By boarding the yacht you confirm that you have read, understood, and agreed to these House Rules on behalf of yourself and all members of your group. Nothing in these House Rules limits any mandatory consumer rights you may have under applicable law.

1. Captain's authority

1.1 Operational and safety authority. The Captain is the highest authority on board for operational and safety purposes during the charter. The Captain has decision-making power on safety of guests, crew, and vessel; navigation and route changes; weather-related decisions (delay of departure, returning to port early); refusal of boarding (intoxicated, dangerous, or unfit guests); termination of the charter (in case of dangerous behaviour or emergencies); changes to schedule due to operational reasons. The Captain's decisions are final for operational and safety purposes during the charter and must be followed immediately. This does not limit any mandatory legal rights you may have after the charter.

1.2 Crew authority. The Captain may delegate authority to the crew (first mate, hostess, deckhand). Instructions given by crew members must be followed as if given by the Captain.

2. Safety rules

2.1 Pre-charter safety briefing. Before departure, the Captain will provide a briefing covering location of life jackets and how to use them; emergency procedures (fire, man overboard, evacuation); location of emergency exits and equipment; use of yacht facilities (toilet, kitchen, electrical); areas off-limits to guests. Attendance is MANDATORY for all guests.

2.2 Life jackets. Must be worn during emergencies, when instructed by the Captain, and during certain activities (e.g. dinghy rides, swimming in open water, water sports). Children under 12 must wear a life jacket whenever on deck. Non-swimmers must wear a life jacket when near the water.

2.3 Swimming and water activities. Always inform the Captain or crew before swimming. Swim only in designated safe areas approved by the Captain. Do NOT swim while the engine is running or near the propeller. Do NOT dive from the yacht without the Captain's permission and depth check. Stay within visible range of the yacht. Use the swim ladder for safe boarding.

2.4 Children on board. Must be supervised by a designated adult AT ALL TIMES. Children under 12 must wear life jackets on deck. Running on deck is prohibited (slip hazard). Children may not enter the wheelhouse, engine room, or galley unless invited by the Captain. Parents/guardians are fully responsible for their children's behaviour and safety.

2.5 Pets on board. Pets are allowed only with prior written permission from the Boat Owner. Pets must be on a leash on deck. Pet owners are fully responsible for their pet's behaviour, sanitation, and any damage caused. Additional cleaning fees may apply (€50–€150 depending on circumstances).

3. Alcohol and substances

3.1 Alcohol consumption. Allowed for adults (18+) in moderation. Excessive intoxication may result in early termination of the charter at the Captain's discretion where the violation is serious or creates a safety risk. Drunk and disorderly behaviour endangering the vessel or other guests is grounds for termination.

3.2 Drugs and illegal substances. STRICTLY PROHIBITED on board — possession or use of any illegal drugs or controlled substances, including substances legal in your home country if illegal in Montenegro. Violations result in immediate termination of the charter (no refund) where the violation is illegal, disembarkation at the nearest port, notification of authorities, full liability for any consequences.

3.3 Smoking. Permitted ONLY in designated outdoor areas at the stern (back) of the yacht. Smoking inside the cabin, salon, or galley is STRICTLY PROHIBITED. Cigarette butts must be disposed of in provided ashtrays — NEVER thrown overboard (environmental violation). E-cigarettes and vaping follow the same rules.

4. Respect for the yacht and crew

4.1 Equipment and property. Treat the yacht, equipment, and furnishings with care. Report any damage immediately to the Captain. Do NOT remove items from the yacht. Damage caused by negligence or misuse will be charged at the documented and reasonable cost of repair/replacement (see §8).

4.2 Cleanliness. Keep common areas tidy. Use designated trash bins. Do NOT throw anything overboard (illegal in Montenegrin waters). Sand, water, and food spills should be reported to the crew.

4.3 Crew treatment. Treat the Captain and crew with respect and courtesy. Verbal abuse, harassment, or threats are not tolerated. Tipping the crew is appreciated but not mandatory (typical: 5–10% of charter fee). Inappropriate physical contact with crew is grounds for charter termination and may result in legal action.

5. Environmental responsibility

5.1 Marine environment. Montenegrin waters are protected. Do NOT throw waste, plastic, glass, or food overboard. Do NOT use cleaning products or sunscreens not labelled "reef-safe" while in the water. Do NOT touch, feed, or chase marine wildlife. Do NOT collect coral, shells, or marine specimens. Use the yacht's holding tank (not the sea) for waste disposal.

5.2 Protected areas. Some bays and coves are protected nature reserves. Anchoring restrictions apply. Follow the Captain's guidance on where you can swim, snorkel, or use water toys.

6. Noise and music

6.1 Music on board. Reasonable volume allowed during daytime. After 22:00, music must be at conversational volume or off. In ports/marinas, follow port noise regulations. Live music or DJ requires prior approval from the Boat Owner.

6.2 Quiet hours. In anchorage areas with other yachts nearby, respect quiet hours 22:00–08:00. No loud parties, shouting, or music after 22:00. Generators and engine running should be minimised at night.

7. Prohibited activities

The following activities are STRICTLY PROHIBITED on board:

  • Illegal activities of any kind
  • Carrying or using firearms or weapons
  • Carrying or using illegal drugs
  • Smuggling of any goods, currency, or persons
  • Fishing without proper licence
  • Spearfishing in protected areas
  • Sex work or pornographic activities
  • Recording crew or other guests without consent
  • Drone use without prior Captain approval and proper licence
  • Bringing fireworks, flares, or pyrotechnics on board (except authorised emergency flares)
  • Activities endangering the vessel, guests, crew, or environment

Violations may result in immediate charter termination, disembarkation, and notification of authorities where the violation is serious, illegal, or creates a safety, security, environmental, or legal risk.

8. Damage and liability

8.1 Security deposit. Some Boat Owners require a refundable security deposit (typically €500–€2,000 depending on yacht value). Held to cover possible damage and refunded after the charter if no damage is found.

8.2 Damage charges for damage caused by negligence or misuse, based on documented and reasonable costs: lost/damaged life jacket €50–€100; damaged or stained upholstery €100–€500; lost/damaged equipment at documented replacement cost; major damage (engine, hull, electronics) documented repair cost plus reasonable, evidenced downtime compensation. Reasonable wear and tear is NOT charged.

8.3 Personal property. Guests are responsible for their own belongings. MyYacht.me and the Boat Owner are not liable for lost or stolen personal items, except where caused by their negligence and to the extent required by mandatory law. Use the yacht's safe for valuables when available. Lost & found items will be held for 30 days, then disposed of.

9. Emergency procedures

9.1 In case of emergency. Stay calm and follow Captain/crew instructions. Locate the nearest life jacket. Move to the assembly point as instructed. Do NOT jump overboard unless instructed.

9.2 Medical emergency. Inform the crew immediately. The yacht has a basic first-aid kit. For serious medical emergencies the Captain will radio for assistance and proceed to the nearest port. Pre-existing medical conditions should be disclosed in the booking form.

10. Photography and privacy

10.1 Personal photography. You may take photos and videos of yourself, your group, and surrounding scenery for personal use. However, photographing crew without permission is prohibited; photographing other guests/yachts without consent is prohibited; commercial photography requires prior approval and may be subject to fees; drone use requires prior Captain approval and a valid Montenegrin drone licence.

10.2 Boat Owner / crew photography. Boat Owner or crew photos showing identifiable guests may be used for marketing only with the guest's prior, freely-given consent. Refusal of photography consent does not affect the charter or the quality of service.

11. Consequences of violations

Consequences are proportionate to the violation.

11.1 Minor violations (e.g. music too loud, smoking in the wrong area): verbal warning; request to comply.

11.2 Serious or repeated violations (activities that endanger safety; illegal activities; damage to the yacht through gross negligence; aggressive or abusive behaviour) may result in: securing, removal, or reporting of prohibited items to competent authorities where lawful and necessary; immediate disembarkation at the nearest port; termination of the charter, with no refund where the violation is serious, illegal, repeated after warning, or creates a safety, security, environmental, or legal risk; documented and reasonable damage charges deducted from security deposit or invoiced separately; notification of relevant authorities; permanent ban from MyYacht.me; civil/criminal proceedings where applicable.

Refunds and consequences in all cases remain subject to your mandatory consumer rights under applicable law.

12. Acknowledgement

By boarding the yacht, you and all members of your group:

  • Confirm you have read and understood these House Rules;
  • Agree to comply with these rules at all times;
  • Accept responsibility for your behaviour and that of your guests;
  • Understand that serious violations may result in charter termination;
  • Acknowledge the Captain's operational and safety authority during the charter.
